ELIGIBILITY: The Charlotte 50/50 Raffle ("Raffle") is open to all legal residents of the fifty (50) United States and the District of Columbia age eighteen (18) or older (except in the case of legal residents of certain states or Washington D.C. where the age of majority is greater than eighteen (18) years of age, such age of majority) at the time of purchase. SCC has the right to request photo identification from any person desiring to enter the Raffle. Employees, officers, directors, trustees and their immediate family members (spouses, siblings, children, household members and the spouses and children of the foregoing) of the Speedway Children’s Charities, a 501(c)(3) charitable organization ("SCC") (collectively, the "Raffle Entities") are not eligible to enter or win the Raffle. By purchasing a ticket for the Raffle (“Raffle Ticket”), each eligible participant (“Participant”) represents that he/she meets all of the eligibility requirements and agrees to be bound by these official rules (“Official Rules”), all applicable laws, ordinances and regulations, and by the decisions of SCC, or its authorized representative. Void wherever prohibited or restricted by law. Subject to all Federal, state and local laws.

HOW TO ENTER:  The Raffle is conducted by SCC onsite at The Dirt Track at Charlotte Motor Speedway (“Speedway”) with the physical address of 5500 Concord Parkway South, Concord, North Carolina 28027 during each day of the motorsports events held November 6-9, 2019. Ticket will be sold November 6, 2019 from 6:00pm-9:00pm EST, November 7, 2019 from 12:00pm-9:00pm EST, November 8, 2019 from 12:00pm-9:00pm EST, November 9, 2019 from 12:00pm-7:00pm EST; unless sold out prior to established times stated (collectively, the "Raffle Period").

Participants may enter the Raffle by purchasing Raffle Tickets from stationary Raffle purchase locations within the Speedway and/or from Raffle Ticket sales representatives roaming in and around the Speedway. Raffle Tickets may be purchased for CASH ONLY(United States Dollars) as follows: one (1) Raffle Ticket for Five Dollars ($5.00). Each Raffle Ticket is a receipt for Participant’s purchase and represents one (1) entry in the Raffle for the Raffle Period and is not eligible for any past or future Raffle drawing. SCC and the other Released Parties (defined below) are not responsible for printing errors in any Raffle-related material or any misdirected, incomplete, lost, late or illegible Raffle Tickets or other errors or problems which may limit a Participant's ability to participate in or win any Raffle. False or deceptive entries or acts will render the Participant ineligible. All entries become the property of SCC and will not be returned. Participants may purchase as many Raffle Tickets as they wish, subject to availability. All Raffle Ticket purchases shall be final. No refunds will be made, except as otherwise determined by SCC in its sole discretion.

RANDOM DRAWING:  One (1) winner will be randomly selected out of the pool of purchased Raffle Tickets at the close of the Raffle Period ("Raffle Winner "). The Participant whose Raffle Ticket number is drawn at the Prize drawing will, subject to verification of eligibility and compliance with these Official Rules, be deemed the Raffle Winner of the Prize for the Raffle. The drawing will be conducted by SCC at the end of the Super DIRTcar Series Big-Block Modified Feature Victory Lane at the Speedway on November 9, 2019 (“Prize Drawing”). In the event of a weather delay, SCC may, in its sole discretion, modify any pre-determined schedule with respect to the Raffle Period and/or the Prize Drawing. The decisions of SCC are final and binding on all matters relating to any Raffle. Odds of winning depend on the total number of eligible entries received/Raffle Tickets purchased. The running total from the Raffle Ticket sales will be periodically displayed and updated on social media and throughout the Speedway during the Raffle Period. The winning Raffle Ticket number will be announced over the Public Address System at the Speedway following the Prize Drawing and listed online at www.speedwaycharities.org and on SCC-Charlotte Instagram, Facebook and Twitter. Participants need not to be present to win.

PRIZE AND HOW TO CLAIM: There is one (1) cash prize and the amount depends on the total dollar amount of Raffle Tickets sold during the Raffle Period (“Prize Amount”). The potential Raffle Winner shall be entitled to a cash prize equal to fifty percent (50%) of the gross Prize Amount.  The remaining proceeds shall be retained by SCC and the programs that SCC supports in its sole discretion. No substitution of Prizes will be allowed for any potential Official Winner. Prizes will not be split amongst various parties. Any unclaimed Prize will be retained by SCC for charitable purposes. ALL COSTS AND EXPENSES ASSOCIATED WITH PRIZE ACCEPTANCE AND REDEMPTION AND USE NOT SPECIFIED HEREIN AS BEING PROVIDED AND OTHER EXPENSES INCURRED BY ACCEPTING ANY PRIZE ARE THE SOLE RESPONSIBILITY OF THE WINNERS AND ARE NOT INCLUDED WITH THE PRIZE.

ALL PRIZE CLAIMS MUST BE MADE BY 11:59 PM EST ON NOVEMBER 18, 2019. THE RAFFLE WINNER MUST PRESENT A WINNING RAFFLE TICKET TO A SCC REPRESENTATIVE AT THE SPEEDWAY UPON THE CONCLUSION OF THE DRAWING OR IF AFTER THE DRAWRING BY CONTACTING SAMANTHA FILCIK AT 704-455-3286 OR SFILCIK@SPEEDWAYCHARITIES.ORG.

The potential Raffle Winner must provide SCC with all information required to claim the Prize (including tax identification information and a copy of potential Raffle Winner’s driver’s license or State identification card). The potential Raffle Winner will receive applicable tax forms which must be executed and returned to SCC prior to receipt of the Prize, along with a copy of potential Raffle Winner’s driver’s license or State identification card. In the event a potential Raffle Winner: (a) does not notify SCC by 11:59 PM EST ON NOVEMBER 18, 2019; (b) is ruled ineligible for any reason; (c) refuses the Prize; or (d) does not return the executed tax forms and copies of potential Raffle Winners’s driver’s license or State identification card within ten (10) business days of notifying SCC of the winning Raffle Ticket the Prize will be forfeited and will be retained by SCC for charitable purposes. Any unclaimed Prize will be retained by SCC for charitable purposes.

TAXES: Each Participant acknowledges that he/she has been informed that the IRS has taken the position that amounts paid to participate in raffles are not gifts and, therefore, the price of a raffle ticket does not qualify as a deductible charitable contribution. The winner is responsible for any and all federal, state and local taxes, fees and other government assessments on the awarded prize. Furthermore, each winner acknowledges that federal law requires, and state law may require, that a tax withholding on certain prize values must be collected from winners upon award or distribution. Federal and state withholding laws are subject to change without notice. The withholding laws in effect at the time of the Prize is claimed will be followed.

TRANSFER OF RAFFLE TICKET: Persons who purchase a Raffle Ticket may opt to give away their Raffle Ticket to another eligible person, but in doing so the purchaser waives any claim he/she might otherwise have to the Prize. A purchaser of any Raffle Ticket may not re-sell his/her Raffle Ticket to other parties, and may not knowingly give Raffle Tickets away to another for the purpose of allowing those other parties to re-sell such Raffle Tickets. All Raffle Tickets which have been resold in violation of these Official Rules shall be void. All individuals who re-sell, purchase, or receive Raffle Tickets in violation of these Official Rules shall be ineligible to participate in the Raffle or to win a Prize.

PARTICIPANT’S GRANT OF LICENSE: By participating in the Raffle and/or receiving the Prize, each Participant hereby irrevocably and perpetually grants to SCC, its affiliates and their respective designees a worldwide license to use, publish, reproduce, create derivative works of, distribute and publicly display any images or likenesses taken or captured of the Participant in connection with his/her participating in the Raffle and/or receiving the Prize (collectively, the “Images”), in any form, media or content which now or hereafter exists, for advertising, promotional or any other commercial purposes as well as non-commercial purposes. Each Participant waives any compensation for any use of such Images. Each Participant hereby releases and waives any claims, demands, damages, losses, liabilities and causes of action arising from SCC’s, its affiliate’s or its respective designee’s, uses of the Images, including, without limitation, any claims for defamation, libel, invasion of privacy, publicity, personality, or exploitation of the Participant’s name or likeness.

RELEASE AND INDEMNITY: By participating in the Raffle, the Participant on his/her behalf and on behalf of the Participant’s spouse, domestic partner, assigns, guardians, executors and legal representatives hereby releases, waives, discharges, covenants not to sue and indemnifies SCC, Charlotte Motor Speedway, LLC, Speedway Motorsports, LLC, Sonic Financial Corporation, Speedway Holdings I, LLC, Speedway Holdings II, LLC, together with all of their past, present or future predecessors, successors, assigns, parent companies, subsidiaries, affiliates, related entities and persons, owners, shareholders, members, partners, directors, managers, employees, agents, consultants, contractors, representatives, sponsors and insurers (“Released Parties”)from any claim or loss arising out of or related to the Participant’s participation in the Raffle, receipt of the Prize, or any exercise by SCC of any of its rights set forth herein, or the regulations promulgated thereunder, or in these Official Rules, including, but not limited to, any claims related to (A) any injury to the Participant (including death) or the Participant’s property that occurs in connection with participation in the Raffle, receiving the Prize or any related activities, (B) any failure to report and pay any income taxes arising from acceptance of the Prize and (C) the Participant’s acts or the acts of any other party with respect to the Participant’s receipt of the Prize, or participation in the Raffle, regardless of whether any such claims are caused in whole or in part by the negligence of any entity or person released hereunder.

GOVERNING LAW:  The Raffle is governed by, and being conducted in accordance with, the laws of the State of North Carolina without giving effect to any choice of law or conflict of law rule of any jurisdiction. Each Participant, the Foundation and the Participant’s Agent hereby agree and confirm that all the elements of the contract created by and between these parties by these Official Rules and each party’s obligations pursuant to this contract have been formed and will be fulfilled and discharged solely within the jurisdiction of the State of North Carolina. Each Participant agrees that: (A) any and all disputes, claims and causes of action not waived arising out of or in connection with the Raffle, or any prizes awarded, shall be resolved individually, without resorting to any form of class action; (B) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering the Raffle, but in no event attorneys’ fees; and (C) under no circumstances will Participant be permitted to obtain awards for, and Participant hereby waives all rights to claim, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. IN NO EVENT SHALL SCC OR ANY RELATED ENTITY BE LIABLE FOR DAMAGES THAT EXCEED THE VALUE OF THE PRIZE AWARDED TO ANY INDIVIDUAL PARTICIPANT IN THE RAFFLE.

DISQUALIFICATION; CHANGES: SCC reserves the right at its sole discretion to disqualify any individual that tampers or attempts to tamper with the ticketing process or the operation of the raffles, re-sells their raffle ticket or violates these Official Rules. SCC reserves the right to, at its sole discretion, cancel, suspend and/or modify the Raffle or disqualify any individual or raffle ticket for purposes of protecting the integrity of the Raffle or addressing changes in business operations or other circumstances, to the extent allowed under applicable law.

CHARITY INFORMATION: The Charlotte 50/50 Raffle is being conducted by the Charlotte Chapter of the Speedway Children’s Charities, a 501©(3) charitable organization, and the address of its headquarters is 5555 Concord Parkway South, Concord, North Carolina 28027. Non-profit Tax ID 56-1331429.

WINNERS' LIST. The winning Ticket number and the Prize amount of the Raffle will be posted on the SCC website and the SCC - Charlotte Chapter social media platforms.
